Introduction

These Terms and Conditions govern the use of services provided by Fortunate Impex Limited, including customs clearing, freight forwarding, cargo handling, haulage, warehousing, and other logistics services. By engaging us to handle your shipment or using our website, you agree to be bound by these terms. If you do not agree with any part of these terms, we ask that you do not use our services.

Our Services

Fortunate Impex Limited provides clearing, forwarding, shipping, and logistics services, including but not limited to customs clearance, freight forwarding by sea and air, import and export logistics, cargo handling, haulage and inland transportation, shipping agency services, trade documentation processing, warehousing, and project cargo handling. The specific scope of services for each client will be agreed upon before work begins.

Client Responsibilities

To enable us to provide our services effectively, clients are expected to provide accurate and complete information about their cargo, including correct documentation, accurate descriptions, and timely instructions. Clients are responsible for ensuring that their goods are legal to import or export and that all information provided to us is true and correct. We cannot be held responsible for delays, penalties, or losses arising from inaccurate or incomplete information provided by the client.

Fees and Payment

Fees for our services will be communicated to clients in advance, based on the nature and scope of the shipment or service required. Payment terms will be agreed upon before services commence, and we reserve the right to withhold the release or delivery of goods until outstanding fees, duties, or charges have been settled in full.

Customs Compliance and Documentation

We make reasonable efforts to ensure that all customs and trade documentation is prepared accurately and submitted in line with applicable Nigerian regulations. However, final decisions regarding customs clearance, duty assessment, and cargo examination rest with the relevant regulatory authorities, and we cannot guarantee specific timelines or outcomes that are outside our control.

Liability and Limitation of Liability

While we take every reasonable precaution in handling, transporting, and processing your cargo, Fortunate Impex Limited shall not be held liable for loss, damage, or delay arising from circumstances beyond our reasonable control, including but not limited to customs delays, port congestion, strikes, natural events, or the actions of third parties such as shipping lines, terminal operators, or government agencies. Where our liability does arise, it shall be limited to the value of the fees paid for the specific service in question, unless otherwise agreed in writing.

Cargo Insurance

We recommend that clients arrange appropriate cargo insurance to cover their goods during transit and clearance. Unless specifically agreed in writing, Fortunate Impex Limited does not provide insurance coverage for client cargo, and clients are encouraged to discuss insurance options with us or their preferred insurance provider before shipment.

Force Majeure

Fortunate Impex Limited shall not be held responsible for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including natural disasters, civil unrest, government action, strikes, or other events commonly recognized as force majeure.

Confidentiality

We treat client information, including shipment details and business documentation, as confidential, and we will not disclose it to third parties except where necessary to provide our services or where required by law.

Termination of Services

Either party may terminate an agreement for services by providing reasonable written notice. Termination does not affect any fees, charges, or obligations that have already accrued prior to the termination date.

Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Federal Republic of Nigeria.

Dispute Resolution

In the event of a dispute arising from our services, we encourage clients to first reach out to us directly so that we can work toward a resolution. Where a dispute cannot be resolved amicably, it shall be subject to the jurisdiction of the appropriate courts in Lagos State, Nigeria.

Changes to These Terms

We may update these Terms and Conditions periodically to reflect changes in our services or applicable regulations. Continued use of our services after any changes have been made constitutes acceptance of the updated terms.
